Dear commissioner Meyerson,


I write you with regard to your response to Mr. Gary Ederer’s letter of February 28th 2008 and Mr. Ederer’s original letter itself.

Mr. Ederer’s letter is inaccurate and grossly misleading for the following reasons. To begin, Mr. Ederer’s letter states in the second paragraph that the cottage in question is an existing summer cottage that has fallen into disrepair. In fact, Mr. Ederer’s cottage has not been occupied as a residence since 1984 when first purchased by the previous owner Brigit DiForio.

During a recent application for a variance by Mr. Ederer before the Rye City Zoning Board of Appeals, we submitted documented proof from the City of Rye tax records that in 1994 the cottage was inspected by the City and noted as abandoned.

Furthermore, the previous owner’s testimony confirmed that the cottage was used last in 1997. You state in your letter that “no Westchester County Health Department approvals are required” and that as a result, Mr. Ederer is free to connect to a self-described “existing gray water tank” without any Health Department inspection or approval. In reality, there is no gray water tank at that location, and if Mr. Ederer is allowed to connect, it should be to an approved septic system at today’s standards. Mr. Ederer has also failed to show how he will supply the cottage with potable water for domestic use.

As I am sure you can see, once again there is a concerted effort to cover up some very serious issues on Hen Island. I formally request that your office investigate Mr. Ederer’s false claims, inspect his abandoned cottage and require Mr. Ederer to comply with all applicable health codes as he has stated he would do at the Zoning Board meeting. It should be noted, I had the Zoning Board meeting videotaped.

If you would like to view the tape, I would be willing to supply the Health Department with a copy. I remain in anticipation of your timely response.
