Dear Mr. Minard,

I would like to bring your attention the fact that Gary Ederer’s construction plan, as filed with the Rye City Building department, indicates that he is going to connect to the “existing gray water tank.”

In fact, On May 5th he has dug a new hole and connected new plumbing to it.
There is no existing gray water tank at this location, and no existing sewage pit. As you well know the cottage has been abandoned for years and previously had only an outhouse servicing the cottage. There was no septic system of any kind.

I would also like to bring to your attention the fact that Mr. Ederer has not applied for any permits to supply his new Cottage with well or City supplied domestic and potable water. He has incorrectly informed the County Health Department in his February 25th letter that the cottage had two bedrooms when it in fact only had one, he is increasing the number of bedrooms and installing a shower in a residence that never had one, contrary to his statements to the County Health Department. In addition Mr. Ederer states in his letter that the cottage will be rebuilt when in fact the previous cottage was completely demolished and a new cottage was constructed including the footings and foundation. All of the above has been documented should you wish to view the photos.

I formally object to Kuder Island Colony Inc. using corporate funds to support Mr. Ederer’s illegal actions per the resolution of the April 1st stockholders meeting.

With reference to our present article 78 proceeding in the Supreme Court against Mr. Ederer, the City of Rye, and Kuder Island Colony Inc., I have advised Mr. Ederer and Kuder Island, by a separate communication, that we will dismiss all litigation should Mr. Ederer decide to connect to a compliant sewage disposal system and install potable water as would be required anywhere else in Westchester County.
